Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CoastPix platform at coastpix.com and its tenant subdomains (the “Service”), operated by Smart Space Integration LLC, of which CoastPix is a product (“CoastPix,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CoastPix provides software that lets professional photographers and studios (“Studios”) manage bookings, contracts, invoices, and photo galleries, and lets their end clients (“Clients”) view and download delivered photos. Features and functionality may change over time.

2. Accounts

You must provide accurate information and are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to hold a Studio account. Notify us promptly of any unauthorized use.

3. Acceptable Use

You agree not to use the Service to upload or distribute unlawful, infringing, or harmful content; to violate the rights of others; to attempt to gain unauthorized access to the Service or its data; to interfere with its operation; or to use it in a way that violates applicable law. We may suspend or terminate accounts that violate these Terms.

4. Content and Ownership

You retain all ownership of the photographs and other content you upload (“Your Content”). You grant CoastPix a limited license to host, store, process, and display Your Content solely to operate and provide the Service to you and the Clients you authorize. You are responsible for having the rights and any necessary consents (including from individuals depicted) to upload and share Your Content.

5. Third-Party Integrations

The Service may let you connect third-party accounts and services, including Google, Microsoft, Apple, and payment and messaging providers. Your use of those services is governed by their own terms and privacy policies, and CoastPix is not responsible for third-party services. Where you connect a Google account, our handling of Google user data is described in our Privacy Policy and complies with the Google API Services User Data Policy.

6. Payments

Paid plans and features are billed through our payment processor. Fees are described at the point of purchase and, unless stated otherwise, are non-refundable. Studios are solely responsible for their own transactions with, and billing of, their Clients.

7. Termination

You may cancel by disabling your account in Plan & Storage. Access ends immediately, and we retain the account and Your Content for 30 days so the Studio can restore it. Permanent deletion becomes available after that 30-day recovery period and cannot be undone. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or its users. We may retain limited billing, transaction, fraud-prevention, security, and legal records when required for legitimate business or legal obligations; those retained records do not preserve access to the canceled Studio account.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, CoastPix will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the twelve months before the claim.

10. Indemnification

You agree to indemnify and hold CoastPix harmless from claims, damages, and expenses arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance.
